Last Updated: November 6, 2014

MoveMeFit, Inc. takes your privacy seriously and has developed this Privacy Policy, and internal policies and practices, to demonstrate its commitment to protecting your privacy and financial information. These privacy policies (the “Privacy Policy”) describe for you, as an individual who is a user of www.movemefit.com and/or the MoveMeFit application, what personal information we collect, manage, use and protect.

We encourage you to read this Privacy Policy carefully when using our website and/or application. By using our website and/or application, you are accepting the practices described in this Privacy Policy.

Routine Information Collection

All web servers track basic information about their visitors. This information includes, but is not limited to IP addresses, browser details, timestamps and referring pages. None of this information can personally identify specific visitors to our website and/or users of our application. The information is tracked for routine administration and maintenance purposes.

We may collect personal information that can identify you, such as your name and email address. When you provide personal information through our website and/or application, the information may be sent to servers located in the United States and other countries around the world.

  • Information you provide. We may collect and store any personal information you enter on our website and/or application or provide to us in some other manner, including personal information that may be contained in any video, comment or other submission you upload or post to the website. This includes identifying information, such as your name, address, e-mail address, and telephone number; your likeness; and, if you transact business with us, financial information such as your payment method (valid credit card number, type, expiration date or other financial information). We may use financial information or payment method to process payment for any purchases, subscriptions or sales made on our website, to protect against or identify possible fraudulent transactions, and otherwise as needed to manage our business. We also may request information about your interests and activities, your gender and age, and other demographic information.

  • Information about others. We may also collect and store personal information about other people that you provide to us. If you use our website and/or application to send others (friends, relatives, colleagues, etc.) a request, referral, information that may interest them or messages (such as invitations) through our system, we may store your personal information, and the personal information of each such recipient.

In the regular course of our business, MoveMeFit may monitor and record phone conversations or email communications between you and MoveMeFit employees for training and quality assurance purposes. We may receive a confirmation when you open or click on content in an email from us, which helps us make our communications to you more useful and interesting. If you do not wish to receive email from MoveMeFit, you may unsubscribe from our mailing list on any of the emails we send.

Cookies and Web Beacons

Where necessary, MoveMeFit uses cookies to store information about a visitor's preferences and history in order to better serve the visitor and/or present the visitor with customized content.

  • Information collected automatically. We automatically collect information from your browser when you visit our website. This information includes your IP address, your browser type and language, access times, the content of any undeleted cookies that your browser previously accepted from us (see "Cookies" below).

Cookies. A cookie is a small text file that is stored on a user’s computer for record keeping purposes. Cookies can be either session cookies or persistent cookies. A session cookie expires when you close your browser and is used to make it easier for you to navigate our website. A persistent cookie remains on your hard drive for an extended period of time.

For example, when you sign in to our website, we will record your user or member ID and the name on your user or member account in the cookie file on your computer. We also may record your password in this cookie file, if you indicated that you would like your password saved for automatic sign-in. For security purposes, we will encrypt any usernames, passwords, and other user or member account-related data that we store in such cookies. In the case of sites and services that do not use a user or member ID, the cookie will contain a unique identifier. We may allow our authorized service providers to serve cookies from our website to allow them to assist us in various activities, such as doing analysis and research on the effectiveness of our site, content and advertising.

When you visit our website, we may assign your computer one or more cookies, to facilitate access to our site and to personalize your online experience. Through the use of a cookie, we also may automatically collect information about your online activity on our site, such as the web pages you visit, the links you click, and the searches you conduct on our site. Most browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies. You may delete or decline cookies by changing your browser settings. (Click "Help" in the toolbar of most browsers for instructions.) If you choose to decline cookies, please note that you may not be able to sign in or use some of the interactive features offered on our website.

  • Other Technologies. We may use standard Internet technology, such as web beacons and other similar technologies, to track your use of our site (see "Web Beacons" below). We also may include web beacons in promotional e-mail messages or newsletters to determine whether messages have been opened and acted upon. The information we obtain in this manner enables us to customize the services we offer our website visitors to deliver targeted advertisements and to measure the overall effectiveness of our online advertising, content, programming or other activities.

Web Beacons. Web beacons (also known as clear gifs, pixel tags or web bugs) are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users or to access cookies. Unlike cookies which are stored on the user’s computer hard drive, web beacons are embedded invisibly on the web pages (or in email) and are about the size of the period at the end of this sentence.

Web beacons may be used to deliver or communicate with cookies, to count users who have visited certain pages and to understand usage patterns. We also may receive an anonymous identification number if you come to our site from an online advertisement displayed on a third-party website.

Advertising partners and other third parties may also use cookies, scripts and/or web beacons to track visitors to our site in order to display advertisements and other useful information. Such tracking is done directly by the third parties through their own servers and is subject to their own privacy policies.

Special Note About Google Advertising. Any advertisements served by Google, Inc., and affiliated companies may be controlled using cookies. These cookies allow Google to display ads based on your visits to this site and other sites that use Google advertising services. As mentioned above, any tracking done by Google through cookies and other mechanisms is subject to Google's own privacy policies.

Controlling Your Privacy

Note that you can change your browser settings to disable cookies if you have privacy concerns. Disabling cookies for all sites is not recommended as it may interfere with your use of some sites. The best option is to disable or enable cookies on a per-site basis. Consult your browser documentation for instructions on how to block cookies and other tracking mechanisms.

Your Choice About Collection of Your Information. You can choose not to provide us with certain information, but that may result in you being unable to use certain features of our website because such information may be required in order for you to register as a member; purchase products or services; participate in a contest, promotion, survey, or sweepstakes; ask a question; or initiate other transactions on our website.

How You Can Access and Change Your Information. If you have an online account with us, you have the ability to review and update your personal information online by logging into your account. You can also review and update your personal information by contacting us. More information about how to contact us is provided below.

We want you to understand when and with whom we may share personal or other information we have collected about you or your activities on our website or while using our services.

These services may include fulfilling orders, processing credit card payments, delivering packages, providing customer service and marketing assistance, performing business and sales analysis, supporting our website functionality, and supporting contests, sweepstakes, surveys and other features offered through our website. These service providers may have access to personal information needed to perform their functions but are not permitted to share or use such information for any other purposes.

  • Law enforcement. When we believe disclosure is appropriate in connection with efforts to investigate, prevent, report or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement; or to enforce our website terms and conditions or other agreements or policies.

  • Corporate transaction. In connection with a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.

Any third parties to whom we may disclose personal information may have their own privacy policies which describe how they use and disclose personal information. Those policies will govern use, handling and disclosure of your personal information once we have shared it with those third parties as described in this Privacy Policy. If you want to learn more about their privacy practices, we encourage you to visit the websites of those third parties. These entities or their servers may be located either inside or outside the United States.

Aggregated and non-personal information. We may share aggregated and non-personal information we collect under any of the above circumstances. We may also share it with third parties to develop and deliver targeted advertising on our websites and on websites of third parties. We may combine non-personal information we collect with additional non-personal information collected from other sources. We also may share aggregated information with third parties, including advisors, advertisers, content contributors and investors, for the purpose of conducting general business analysis. For example, we may tell our content contributors the number of video views and the most popular videos accessed. This information does not contain any personal information and may be used to develop website content and services that we hope you and other users will find of interest and to target content and advertising.

Third-Party Websites

There may be a number of places on our website, our application, or through our services where you may click on a link to access other websites that do not operate under this Privacy Policy. For example, if you click on an advertisement or a search result on our website or in our application, you may be taken to a website or application that we do not control. These third-party websites may independently solicit and collect information, including personal information, from you and, in some instances, provide us with information about your activities on those websites. This Privacy Policy applies only to MoveMeFit.com and the MoveMeFit application and not to other websites or applications accessible from MoveMeFit or that you use to access MoveMeFit, each of which may have privacy policies materially different from this Privacy Policy. If you visit other websites or use other applications, MoveMeFit is not responsible for the privacy practices or content of those sites or applications. We recommend and it is your responsibility to review the privacy policies of non-MoveMeFit websites and applications to confirm that you understand and agree with them.

We have implemented physical, electronic, and managerial procedures to safeguard and secure the information we collect. Credit card and personal information are transmitted by secure servers.

We want you to feel confident using our website and/or application to transact business. However, no system or data transmission is guaranteed to be 100% secure. Although we take steps to secure your information, we cannot guarantee the security of information you transmit to or from the site, applications, or through the use of our services, and you provide this information at your own risk. Users should also take care with how they handle and disclose their personal information and should avoid sending personal information through insecure email. Accordingly, we disclaim liability for the theft, loss or interception of, or unauthorized access or damage to, your data or communication by using this site, applications and our services. You acknowledge that you understand and assume these risks.

We will not share such Health Data with third parties without your express consent, and then we will do so only for purposes of enabling the third party to provide health and/or fitness services. In the event of any conflict between this section and any other provision in this Privacy Policy, the provisions of this section shall control with respect to Health Data.

We collect this Health Data via the Apple HealthKit as the only source. Apple may choose to gather this data from other applications, your data input on iOS, and your wearables. For this or related information, please refer to www.apple.com.
